요약The spread of false information on online platforms has become a global concern, prompting governments worldwide, including Taiwan, to enact legislation to tackle the issue. This research defines false information as both intentional and unintentional inaccuracies, including misinformation, disinformation, and malformation. In 2022, the Taiwanese government proposed the Digital Intermediary Services Act (DISA) draft to regulate false information online. However, societal concerns over its content moderation and platform regulations led the government to pause the legislative process, leaving platform governance unresolved. This study analyzes the DISA draft and offers policy recommendations.This dissertation employs three methods to collect data: comparative legal analysis, participant observation, and in-depth interviews. First, I compared five case studies (EU, France, Germany, UK, and Singapore) to gain insights into Taiwan's regulatory framework. Second, to understand Taiwan's situation, I participated in a meeting organized by Taiwan's National Communications Commission (NCC), where stakeholders discussed illegal content regulation and internet governance. Third, I interviewed 19 platform governance stakeholders to gather their views on the DISA.In my dissertation, I analyzed the controversies surrounding DISA's content moderation and platform governance, focusing on legal ambiguity, insufficient human rights safeguards, and a top-down approach with limited co-regulation. My research also identifies issues in DISA's legislative process, including the government's overestimation of enforcement capacity, a rushed timeline, and limited stakeholder engagement. Additionally, DISA's extensive adoption of foreign regulations without considering their historical context raised concerns.Research findings indicate that without the DISA, Taiwan's platform governance faces significant challenges. Thus, I advocate for specific legislation to strengthen the DISA draft. Key policy recommendations are as follows. First, the government should ensure that regulations align with international human rights standards. Second, it should review and refine existing laws to minimize impacts on freedom of expression. Third, platform classification standards should better reflect Taiwan's market. Fourth, the government should promote co-regulation by involving more non-governmental actors. Finally, soft law should be prioritized over hard law.This dissertation examines Taiwan's platform governance as a case study within the global context. This research offers practical contributions to the Taiwanese government through policy recommendations and enhances academic understanding of key aspects of platform governance.
